The year 2025 will bring major regulatory changes that you should definitely not overlook.

The Artificial Intelligence Act

From February 2025, the use of artificial intelligence systems that pose what is known as an unacceptable risk will be banned. This includes technologies designed to be deceptive or manipulative, social scoring, exploiting user vulnerabilities (e.g. based on age, disability or social situation), creating databases for facial recognition or monitoring employee behaviour in the workplace. The definition of risk is based on the functions of the AI in question - the key question is what exactly the system does and how it can affect individuals and society.

It is therefore essential for the fiduciary to monitor this issue closely. Artificial intelligence is becoming increasingly integrated into company processes, and controlling its tools and settings can be key to ensuring compliance with new regulations. Another challenge is the ill-advised use of language models by employees, which companies are often unaware of.

Keep an eye on the changes and consider controlling the AI tools in your company.

Cookies and tracking technologies

Beware the use of tracking pixels* in emails! Without user consent, you may face penalties.

* Tracking pixels are tiny graphical objects, usually 1×1 pixels in size, embedded in an email or web page. Although they are not visible to the user, they have specific functions that allow you to track their behaviour.

Digital Services Act (DSA) - new interpretation

The DSA is fully effective from February 2024 and brings new rules for transparency, removal of illegal content and consumer protection. An important interpretation clarified that e-commerce operators without reviews are not automatically considered to be hosting.

However, the DSA does not only apply to e-shops. Operators of restaurants, hotels, public transport or shopping malls should also take notice if they offer free internet access on their premises. The regulation applies to anyone providing publicly accessible Wi-Fi and brings new obligations related to transparency and user protection.
